Rental Agreement

Express Assumption of Risk: The renter agrees that he/she is renting, operating, and using facilities provided by Camper’s Point RV Park at their own risk. The renter agrees that he/she is voluntarily participating in all activities related to the rental, operation, or use of the rental facilities and assumes all risk of injury, illness, damage, or loss that might result, even if the risks arise out of the negligence or fault of CPRP, which may be both foreseen and unforeseen.

Nature, Animals, and Rodents: Renters and occupants acknowledge and understand that camping in forested/rural locations increases the chance of encountering wild animals, rodents and insects at RV sites and in rental trailers. CPRP makes every effort to rid the rental trailers of insects and rodents prior to your stay including the use of non-toxic deterrents. You may see these deterrents during your stay. CPRP may not have been successful in completely ridding your rental trailer of all insects, rodents, or wild animals prior to your stay. You agree you will not hold CPRP liable for any monetary compensation, damages, or injuries as a result of any encounters with nature, domesticated animal, wild animals, rodents or insects.

Waiver/Release of Liability: by execution of this release, the renter agrees that Matthew Spurlock DBA Campers Point RV Park, also known as CPRP, shall not be liable for any damages arising from personal injuries sustained by the undersigned, any minor children, and any other occupants/visitors under the undersigned’s custody, care and control, as a result of any and all activities related to the rental, operation, or use of facilities provided by CPRP. The undersigned assumes full responsibility for any such injuries or damages which may occur, and further agrees that CPRP shall not be liable or responsible for any theft, damage or loss of personal property.

Liability to Third Parties: the renter agrees that he/she will indemnify and hold harmless CPRP for all personal injuries, property damages, or any other damages to any and all third parties, including, but not limited to, operators and occupants of other rentals, facilities and equipment provided by CPRP.

Hold Harmless Provision: Renter agrees to hold Matthew Spurlock DBA Campers Point RV Park harmless from any and all claims, including personal injury or tort action, arising from the use or maintenance of the leased premises made by any person whomsoever, including customers, visitors, neighbors, agents or representatives of the Renter.

Default Clause: If the Renter shall fail to pay the rent, then the rental agreement is terminated and the Renter shall be responsible for all costs, including attorney’s fees incurred by the Owner in and about enforcing this and any other provision of the lease.
